LATIN SPIRITS – Australia

At LATIN SPIRITS, we take great care in sourcing, storing, handling and dispatching our products. Due to the nature of the goods we sell, including alcohol products, limited releases, premium spirits, and products intended for responsible adult purchase and consumption, all orders placed through our online store are treated as final once confirmed, subject always to the customer rights that apply under the Australian Consumer Law.
This policy explains how LATIN SPIRITS manages returns, exchanges, credits and refunds for purchases made through our online store.
1. General policy position
LATIN SPIRITS does not offer returns, refunds or exchanges for change of mind, including where a customer:
changes their mind after placing an order;
decides they no longer want the product;
orders the wrong product, quantity or variant by mistake;
finds the item cheaper elsewhere;
does not like the taste, aroma, finish, style, expected profile or subjective characteristics of a product;
purchases a product as a gift and the recipient does not want it;
fails to read the product description, alcohol content, bottle size, flavour profile or other product information prior to purchase;
is unavailable to receive the order, subject to any rights otherwise required by law.
All purchases should therefore be made carefully and only after reviewing product descriptions, bottle sizes, pricing, delivery details and relevant warnings.
2. Australian Consumer Law
Nothing in this policy excludes, restricts or modifies any rights or remedies that a customer may have under the Australian Consumer Law.
If a product sold by LATIN SPIRITS fails to meet a consumer guarantee that cannot legally be excluded, the customer may be entitled to a remedy such as a replacement, refund, repair or other appropriate solution, depending on the circumstances and the nature of the issue.
3. Circumstances where a return, replacement or refund may be considered
LATIN SPIRITS may review a request where:
the wrong item was supplied;
the item arrived damaged in transit;
the item was materially defective at the time of delivery;
the item was substantially different from its description;
there is another issue that gives rise to a remedy under applicable law.
Any such request will be assessed on a case-by-case basis, acting reasonably and having regard to the available information, including photographs, order details, delivery records, packaging condition, and any other relevant evidence.
4. Circumstances where returns or refunds will generally not be accepted
Subject to Australian Consumer Law, LATIN SPIRITS will generally not accept returns or provide refunds where:
a customer simply changes their mind;
a bottle, seal or packaging has been opened, tampered with, consumed or used;
a product has been stored incorrectly after delivery;
the customer has provided an incomplete, incorrect or inaccessible delivery address;
delivery has been delayed due to a third-party courier, weather, access restrictions or other events outside our reasonable control;
a customer fails or refuses lawful age verification or proof-of-identity procedures on delivery;
the product was purchased during a promotion, clearance or limited-release allocation and the issue is merely a preference-based concern rather than a legal fault;
the customer’s complaint relates only to personal taste or subjective preference.
5. Delivery, age verification and failed delivery
Because LATIN SPIRITS sells alcohol products, deliveries may require:
the recipient to be aged 18 years or over;
a signature upon delivery;
proof of age or identity where requested by the courier or delivery partner;
delivery to a lawful and serviceable Australian address.
If delivery cannot be completed because nobody suitable is available to accept the order, because age verification is not satisfied, or because access is unavailable, LATIN SPIRITS reserves the right to charge any reasonable redelivery, return-to-sender, handling or re-dispatch costs incurred.
Where a returned parcel remains unopened and is returned to LATIN SPIRITS in saleable condition, we may, at our discretion, offer either:
re-dispatch at the customer’s cost; or
store credit or partial refund less original shipping and any actual handling, return and re-shipping costs,
except where Australian Consumer Law requires otherwise.
6. Timeframe for raising an issue
If there is a problem with an order, customers must contact LATIN SPIRITS within 48 hours of delivery by emailing [insert email] with:
full name;
order number;
delivery address;
description of the issue;
clear photographs of the product, label, seal, external packaging and any damage.
Prompt notice helps us investigate with carriers, warehouses and suppliers while records are still current.
7. Condition of goods for any approved return
Where LATIN SPIRITS requests that a product be returned for inspection, the item must:
be returned only if requested by us;
remain unopened unless the nature of the issue makes opening unavoidable;
be returned with original packaging where reasonably possible;
be packaged securely in accordance with our instructions.
LATIN SPIRITS does not accept responsibility for items returned without prior approval.
8. Return method
Returns, where approved, must only be sent using the return method directed by LATIN SPIRITS. Customers must not send alcohol products back without written approval and instructions.
If a return is approved because the product was incorrect, damaged or otherwise not compliant with applicable consumer guarantees, LATIN SPIRITS will advise the appropriate next step, which may include:
replacement;
refund;
credit;
collection arrangement; or
no return required in some cases.
9. Refund method and timing
If LATIN SPIRITS determines that a refund is appropriate, refunds will generally be processed back to the original payment method used for the order, unless otherwise agreed or required.
Processing times may vary depending on the payment provider, bank, card issuer and administrative circumstances, but approved refunds are generally initiated within a reasonable time after the outcome is confirmed.
Shipping charges, service charges and ancillary costs are generally not refundable, except where required by law or where LATIN SPIRITS determines otherwise in its sole discretion.
10. Store credit and replacements
Where appropriate, LATIN SPIRITS may choose to offer:
a replacement product;
store credit; or
another reasonable resolution,
instead of a monetary refund, except where Australian Consumer Law requires a different remedy.
11. Product information and customer responsibility
Customers are responsible for reading product pages carefully before purchasing, including:
bottle size;
alcohol content;
flavour descriptors;
ingredients or infusion notes;
shipping constraints;
any promotional terms;
any limitations stated on product pages.
LATIN SPIRITS endeavours to display products, descriptions and images as accurately as reasonably possible, but minor variations in packaging, labelling, vintage, presentation or producer updates may occur from time to time.
12. Promotional, seasonal and limited-release products
Certain products may be:
limited allocation;
one-off releases;
seasonal offers;
special bundles;
promotional stock.
Subject to Australian Consumer Law, such products are generally sold as final sale and may not be returned for change of mind, preference, or other non-fault reasons.
13. Fraud prevention and abuse
LATIN SPIRITS reserves the right to refuse a return, replacement, refund, re-dispatch, cancellation or other accommodation request where we reasonably suspect:
policy abuse;
misuse;
fraudulent conduct;
attempted resale misuse;
tampering;
inaccurate or misleading claims regarding the condition of goods.
